An agreement on supervision over compliance with the requirements of technical regulations comes into force in the EAEU

The agreement on the principles and approaches for exercising state control (supervision) over compliance with the requirements of the technical regulations of the Eurasian Economic Union entered into force on February 24, 2023.

The document establishes uniform principles for the interaction of state control (supervision) bodies over compliance with the requirements of technical regulations and authorized bodies for accreditation when they take measures in relation to unsafe products and unreasonably issued conformity assessment documents. The implementation of the Agreement provides for both the development of new acts of the Union and the harmonization of the national legislations of the Member States.

The agreement provides:

- creation of mechanisms for interaction between state control bodies and accreditation bodies both within the country and between countries, in order to identify and withdrawal from the market of unsafe products, as well as prompt decision-making on the suspension or termination of unreasonably issued conformity assessment documents. To implement these mechanisms, the Procedure for the interaction of state control bodies with accreditation bodies will be developed;

- establishment of the Procedure for consideration by the Commission of the appeal of a member state of the EAEU on disagreement with the measure taken based on the results of activities carried out by the state control body of another member state. The document will define the rules for filing and considering such an appeal, as well as the procedure for deciding on recommendations for action taken.

These acts of the Union will be adopted by the Council of the Commission.

The agreement also provides for the creation of a unified information system on unsafe products, which will ensure the prompt exchange of information on the measures taken between state control bodies and accreditation bodies.

The implementation of the Agreement will increase the level of integration of the EAEU countries in the field of state control over compliance with the mandatory requirements of technical regulations. At the same time, cases of establishing unilaterally unreasonable trade bans will decrease.
