About Certificates of the Customs Union (BY, KZ, RU)
With respect to multiple enquiries from the representative offices of foreign companies, Belarus companies about performing technical expertise and evaluation of Customs Union Certificates and Declarations, issued outside Republic of Belarus;
Taking into account that the enquiries are caused by doubts of the companies in the content and justification for issuing of these documents, possible risks from their use as a basis for placing products on the Belarus market, as well as worries about their conformity to the legal norms and rules;
Based on the results of the evaluation performed, herewith we submit the following information:
All evaluated documents are done and issued with a considerable number of gross non-conformities against the rules and procedures effective in the Republic of Belarus, Russian Federation, the Republic of Kazakhstan and the Customs Union. The Certificates/Declarations are issued to:
- PHILIPS (Certification Body Korporacia Standart «Корпорация Стандарт»);
- SONY (Certification Body TESTBET «ТЕСТБЭТ»);
- PANASONIC (Certification Body TESTBET «ТЕСТБЭТ»);
- PIONEER (Certification Body TESTSERTIFIKO «ТЕСТСЕРТИФИКО»);
- ELECTROLUX (Kaluzsky Center for Certification and Marketing «Калужский центр сертификации и маркетинга»))
- BEKO, BLOMBERG, HANSA (Certification Body IVANOVO-CERTIFICAT of Ivanov Certification Fund «ИВАНОВО-СЕРТИФИКАТ» ООО «Ивановский фонд сертификации»).
The most significant non-conformities are:
- - Products of different design are included in the scope of same Certificate;
- - Required basis for issuing Certificates for series production are not available with respect to factory inspections and test volume;
- - None of the Certificates/Declarations are registered in the Single Register of issued Customs Union Certificates/Declarations;
- - Required product identification is not available;
- - Mandatory standards are not specified;
- - Validity of Certificates is not in line with national certification rules of Russian Federation;
- - Declarations are issued for products which are subject to mandatory certification.
Taking into account the information above, herewith we confirm your doubts about content and legitimacy of Customs Union Certificates/Declarations. We consider your concern about their conformity to the legal norms/rules as timely.
These Certificates/Declarations cannot be the basis for legitimate placing of the products on Belarus market, as they violate the basic Agreements of the Customs Union in the sphere of technical regulation of the Republic of Belarus, Russian Federation and the Republic of Kazakhstan, Decisions, Provisions of the Customs Union Commission, as well as National rules and procedures.
The current situation discredits the idea of the Customs Union, which has the single system of technical regulation as the basis, as well as endangers economic security of the Republic of Belarus. Reason for this – is absence of unified rules and procedures in the sphere of certification/declaration, accreditation, market surveillance and responsibility for placing product on the market.
In our opinion, the most appropriate decision in this situation and until the set of required documents would be developed - is to be guided by National legislation and National Certificates with respect to products manufactured in third countries.
